Please read these Terms carefully before using BitaServer. By accessing our platform, you agree to be bound by these terms and all applicable laws.

By accessing or using any BitaServer service — including our website, control panel, or hosted servers — you agree to be bound by these Terms of Service. If you do not agree to any part of these terms, you must not use our services.
You must be at least 13 years of age to use BitaServer services. If you are under 18, you must have parental or guardian consent. By using our services, you represent that you meet these eligibility requirements.
BitaServer reserves the right to modify these Terms at any time. We will notify users of significant changes via email or platform notice. Continued use of the service after changes are posted constitutes acceptance of the updated Terms.
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at support@bitaserver.com if you suspect unauthorized access to your account. BitaServer is not liable for losses resulting from unauthorized account access caused by your failure to secure your credentials.
You agree to provide accurate, current, and complete information when creating your account and to keep this information updated. Providing false information may result in account termination without refund.
Each account is intended for a single user or organization. Account sharing with third parties for the purpose of circumventing usage limits or billing is prohibited.
BitaServer services are provided for lawful game server hosting and related activities. You may use our infrastructure to host game servers, run game-related applications, and manage your gaming community.
You must not use BitaServer services to: launch DDoS or other cyberattacks against any target; host illegal content; send spam or unsolicited communications; engage in cryptocurrency mining; run proxies or VPN services without written permission; or violate any applicable law.
You may not artificially inflate resource usage, run bots that consume excessive bandwidth, or engage in any activity that degrades performance for other users on shared infrastructure.
Violation of this Acceptable Use Policy may result in immediate account suspension or termination without refund. We reserve the right to suspend services without notice if we detect activity that poses a security risk to our infrastructure or other customers.
BitaServer commits to the following monthly uptime SLAs: Starter plan — 99.5%, Pro plan — 99.9%, Elite plan — 99.99%. These SLAs exclude scheduled maintenance windows, which will be announced at least 24 hours in advance.
If uptime falls below the guaranteed SLA threshold, eligible customers will receive service credits calculated at 10× the pro-rated daily cost per hour of excess downtime. Credits are applied automatically to the next billing cycle.
We perform routine maintenance to keep our infrastructure secure and performant. Maintenance windows are announced in advance and are excluded from SLA calculations.
BitaServer is not liable for service unavailability caused by events beyond our reasonable control, including natural disasters, internet outages, government actions, or third-party infrastructure failures.
Services are billed in advance on a monthly or annual basis. Payment is due at the start of each billing cycle. Failure to pay may result in service suspension after a 3-day grace period.
Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You are responsible for cancelling your subscription if you do not wish to be charged.
BitaServer may change service pricing with 30 days' written notice. Price changes take effect at the next renewal date. If you do not agree with the new pricing, you may cancel your subscription before the renewal date.
Prices displayed may not include applicable taxes. You are responsible for all taxes applicable to your use of our services based on your jurisdiction.
You retain all ownership rights to the content and data you store on BitaServer servers. We do not claim any intellectual property rights over your server data, game worlds, or configurations.
You are solely responsible for the content hosted on your server. You agree not to host content that is illegal, infringes on third-party intellectual property, or violates our Acceptable Use Policy.
While we provide automated backup features on Pro and Elite plans, you are ultimately responsible for maintaining your own backups. BitaServer's backup service is provided as a convenience and is not a substitute for your own backup strategy.
Upon account termination, your server data will be permanently deleted within 7 days. We recommend you export all necessary data before cancelling your account.
All trademarks, logos, service marks, and trade names displayed on the BitaServer platform are the property of BitaServer or their respective owners. You may not use our branding without prior written permission.
If you provide feedback or suggestions about our services, you grant BitaServer a non-exclusive, royalty-free license to use that feedback to improve our products and services.
BitaServer services are provided "as is" without warranty of any kind, express or implied. We do not warrant that services will be uninterrupted, error-free, or that defects will be corrected.
To the maximum extent permitted by applicable law, BitaServer's total liability to you for any claims arising from or related to these Terms or our services shall not exceed the amount you paid to BitaServer in the 3 months preceding the claim.
In no event shall BitaServer be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of our services.
You may terminate your account at any time by cancelling your subscription through the dashboard or contacting our billing team. Termination takes effect at the end of the current billing period unless you qualify for a refund under our Refund Policy.
We may suspend or terminate your account immediately without notice if you violate these Terms, engage in fraudulent activity, or pose a security risk to our platform. In cases of non-payment, we provide a 3-day grace period before suspension.
Upon termination, your right to access and use our services immediately ceases. Server data is deleted within 7 days. Provisions of these Terms that by their nature should survive termination will survive.
These Terms shall be governed by and construed in accordance with the laws of Bangladesh, without regard to its conflict of law provisions.
In the event of a dispute, we encourage you to contact us first at support@bitaserver.com. We resolve most issues within 48 hours. If a dispute cannot be resolved through direct communication, it shall be submitted to binding arbitration in Dhaka, Bangladesh.
You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class or representative action.

These Terms of Service constitute the entire agreement between you and BitaServer regarding your use of our services. If any provision of these Terms is found to be invalid, the remaining provisions will continue in full force and effect.
